Terms and Conditions for Marutek Safaris

Welcome to Marutek Safaris. By accessing our website, booking a safari, or using our travel services, you agree to be bound by these Terms and Conditions. Please read them carefully before making any reservation. These terms govern the relationship between you and Marutek Safaris and outline your rights and responsibilities as a traveler.

1. Booking and Payment

  • Reservation Confirmation: All bookings are subject to availability. A confirmed reservation will be issued upon receipt of the required deposit and acceptance of these terms.
  • Deposit Requirements: A non-refundable deposit of 30% of the total tour cost is required at the time of booking to secure your reservation. The remaining balance is due 45 days prior to departure.
  • Late Bookings: For bookings made within 45 days of departure, full payment is required at the time of booking.
  • Payment Methods: We accept bank transfers, Visa, Mastercard, and American Express. All payments are processed in USD, EUR, or KES as specified in your invoice.
  • Price Guarantee: Prices quoted are based on current exchange rates and are subject to change until full payment is received. Once paid, your price is guaranteed.

2. Cancellation and Refund Policy

  • Cancellation by Client: Cancellations must be received in writing. Refunds are processed as follows:
    • 60+ days before departure: Full refund minus 10% administrative fee
    • 30-59 days before departure: 50% refund of total tour cost
    • 15-29 days before departure: 25% refund of total tour cost
    • Less than 14 days before departure: No refund
  • Cancellation by Marutek: In the unlikely event we cancel a tour due to unforeseen circumstances, you will receive a full refund or the option to rebook for a future date.
  • Travel Insurance: We strongly recommend purchasing comprehensive travel insurance to protect against unforeseen cancellations, medical emergencies, and trip interruptions.
  • No-Show Policy: Failure to arrive at the designated meeting point without prior notification will result in forfeiture of the full tour cost with no refund.
  • Force Majeure: Marutek is not liable for cancellations or delays caused by events beyond our control including natural disasters, political instability, strikes, or health emergencies.

3. Itinerary Changes and Flexibility

  • Schedule Adjustments: While we strive to adhere to published itineraries, Marutek reserves the right to modify routes, accommodations, or activities due to weather conditions, road closures, wildlife movements, or other operational requirements.
  • Accommodation Substitutions: In the event a listed lodge or camp is unavailable, we will arrange alternative accommodation of similar or higher standard at no additional cost.
  • Wildlife Viewing: While we maximize opportunities for exceptional wildlife encounters, Marutek cannot guarantee sightings of specific animals as wildlife is wild and unpredictable.
  • Flexibility: Our guides may adjust schedules to optimize wildlife viewing opportunities or accommodate group preferences. Your cooperation is appreciated.
  • Client Requests: Special requests such as dietary needs, room preferences, or activity additions should be communicated at booking and are subject to availability.

4. Health, Safety, and Responsibility

  • Medical Conditions: Clients must disclose any medical conditions, allergies, or physical limitations at the time of booking. Marutek reserves the right to decline participation if a tour is deemed unsuitable for the client's condition.
  • Vaccinations and Medications: Clients are responsible for obtaining recommended vaccinations, malaria prophylaxis, and any required medications prior to travel. Consult your healthcare provider at least 4-6 weeks before departure.
  • Travel Insurance: Comprehensive travel insurance covering medical evacuation, trip cancellation, baggage loss, and personal liability is mandatory for all travelers.
  • Personal Responsibility: Clients are responsible for their own safety and the security of personal belongings. Marutek is not liable for lost, stolen, or damaged items.
  • Conduct: We reserve the right to terminate services for any client whose behavior disrupts the tour, poses a safety risk, or violates park regulations. No refund will be provided in such cases.

5. Travel Documentation and Requirements

  • Passport and Visas: Clients are solely responsible for obtaining valid passports (minimum 6 months validity beyond travel dates) and required visas for all destinations visited. Marutek can provide guidance but is not liable for entry refusal.
  • Vaccination Certificates: Yellow fever vaccination certificates are required for entry into Kenya and other East African countries. Failure to present valid documentation may result in denied entry at the client's expense.
  • Flight Arrangements: International flights are the client's responsibility unless included in a package. We recommend arriving at least one day before safari departure to allow for unforeseen delays.
  • Airline Liability: Marutek is not responsible for airline schedule changes, cancellations, or baggage issues. Travel insurance is essential for such events.
  • Meeting Points: Detailed meeting instructions will be provided upon booking confirmation. Clients are responsible for arriving at designated meeting points on time.

6. Liability and Limitation

  • Third-Party Services: Marutek acts as an intermediary for airlines, hotels, lodges, and ground operators. We are not liable for acts, omissions, or defaults of third-party service providers.
  • Personal Injury: While we take every precaution for client safety, Marutek is not liable for personal injury, accidents, illness, or death during tours. Clients assume these risks inherent in adventure travel.
  • Property Loss: Marutek is not responsible for loss, theft, or damage to personal property including luggage, cameras, and electronics during the tour.
  • Liability Cap: In the event of any liability arising, Marutek's maximum liability shall not exceed the total amount paid for the tour package.
  • Waiver of Claims: By participating in our tours, clients waive any claims against Marutek, its employees, agents, and affiliates for damages arising from tour participation.

7. Photography and Marketing

  • Image Rights: Marutek may take photographs or videos during tours for promotional purposes. By booking, you grant us permission to use your image in marketing materials unless you specifically opt out in writing.
  • Client Photography: We encourage clients to capture their safari memories. However, commercial use of images requires prior written consent from Marutek.
  • Reviews and Testimonials: We appreciate feedback. Testimonials may be used for promotional purposes with client consent.
  • Privacy: Personal information is handled in accordance with our Privacy Policy. We do not sell or share client data with third parties for marketing purposes.

8. Governing Law and Dispute Resolution

  • Jurisdiction: These Terms and Conditions are governed by the laws of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
  • Mediation: In the event of a dispute, both parties agree to first attempt resolution through good-faith mediation before pursuing legal action.
  • Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Amendments: Marutek reserves the right to modify these terms at any time. Changes become effective upon posting to our website. Bookings made prior to changes are governed by the terms in effect at the time of booking.
